1. Introduction

Welcome to Hong Kong Heritage Explorer. These Terms of Service ("Terms") govern your use of our website, located at hongkongheritageexplorer.com (the "Site") and the services offered through it (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Hong Kong Heritage Explorer provides cultural and historical tourism services in Hong Kong, including guided tours, workshops, educational experiences, and related services. These Terms apply to all users of our Site and Services, including tour participants, visitors, and customers.

2. Use of Our Services

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.
• To impersonate or attempt to impersonate our company, an employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm our company or users of the Services.

3. Booking and Cancellation Policy

When booking our tours or workshops, you agree to provide accurate, current, and complete information. All bookings are subject to availability and confirmation. Payment is required at the time of booking unless otherwise specified.

Cancellation Policy:

• Cancellations made 7 or more days before the scheduled tour/workshop: Full refund minus a 10% administrative fee.
• Cancellations made 3-6 days before the scheduled tour/workshop: 50% refund.
• Cancellations made within 48 hours of the scheduled tour/workshop: No refund.

We reserve the right to cancel any tour or workshop due to inclement weather, insufficient participation, or other unforeseen circumstances. In such cases, we will offer a full refund or the option to reschedule.

4. Intellectual Property Rights

The Service and all of its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Hong Kong Heritage Explorer and its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

• Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

5. User Content and Conduct

Our Services may allow you to post, submit, publish, display, or transmit content such as reviews, comments, suggestions, and other materials ("User Content"). All User Content must comply with the standards set out in these Terms.

In no event will Hong Kong Heritage Explorer, its affiliates or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

7. Indemnification

You agree to defend, indemnify, and hold harmless Hong Kong Heritage Explorer, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

8. Safety and Conduct During Tours

Participants in our tours and workshops are expected to follow safety instructions provided by our guides. Hong Kong Heritage Explorer is not responsible for any injury, loss, or damage suffered by participants who do not follow safety guidelines or engage in reckless behavior.

Participants must:

• Arrive at the designated meeting point at least 10 minutes before the scheduled start time.
• Wear appropriate clothing and footwear for the activity and weather conditions.
• Inform our guides of any medical conditions or physical limitations that may affect participation.
• Respect local customs, traditions, and historical sites visited during the tour.
• Not be under the influence of alcohol or drugs during the tour or workshop.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of, or related to, them, their subject matter or their formation shall be governed by and construed in accordance with the laws of Hong Kong SAR, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of Hong Kong SAR, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

10. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
